El consentimiento informado en el Ensayo Clínico. Metodología para su elaboración. Revisión bibliográfica.
Abstract
La medicina ha cambiado más en los últimos cincuenta años que en toda su historia, dichas modificaciones han afectado tanto a los aspectos científicos como los éticos. A punto de partida de los horrendos crímenes cometidos durante la Segunda Guerra Mundial con los prisioneros de guerra en los campos de concentración alemanes, los cuales eran sometidos a crueles experimentos sin solicitárseles su voluntariedad para participar en los mismos; quedaron establecidos los dos códigos más antiguos conocidos en la historia: el Código de Nuremberg (1947) y la Declaración de Helsinki (1964) que abogan por salvaguardar la integridad de todos los sujetos participantes en una investigación científica y conciben dentro de sus postulados éticos el Consentimiento Informado como requisito indispensable de todo Ensayo Clínico, pero no siempre estos derechos son respetados ni se sigue una metodología correcta para su elaboración , es por ello que nos vimos motivados a desarrollar una búsqueda bibliográfica con el fin de unificar criterios y ampliar los conocimientos que se tienen al respecto, quedando demostrado que: el Consentimiento Informado es el pilar fundamental del principio de autonomía; los pacientes en pleno uso de sus facultades tienen prioridad sobre el médico para tomar sus decisiones; en los que no estén en pleno uso de las mismas se acepta legalmente la participación de un representante legal; la elaboración del Consentimiento Informado debe seguir una metodología correcta y la firma del facultativo debe aparecer en dicho documento para no eludir su responsabilidad ética y legal.
